1. About these terms
These Terms of Use (“Terms”) govern your access to and use of the website at operatorassured.co.uk and the staff training and compliance portal at portal.operatorassured.co.uk (together, the “Service”). The Service is provided by PSV Compliance & Training Ltd, a company registered in England and Wales (company number 14891261; VAT registration GB 444 224 123). By using the Service you accept these Terms. If you do not accept them, do not use the Service.
2. The service we provide
OperatorAssured is a multi-tenant compliance portal for transport operators. It provides:
- Staff training modules with knowledge checks and written assessments
- Manager review workflows for submitted assessments
- Walkaround check, defect record and training-matrix tooling
- Audit-ready evidence pack export
- Per-tenant configuration including module selection and operator branding
The marketing site at operatorassured.co.uk provides public information about the Service, pricing tiers and a contact form for demo requests. Submitting a demo request does not create a contract; it is an invitation for us to respond.
3. Eligibility and accounts
You must be at least 18 years old and authorised by your operator to hold a portal account. Each account is for a single named individual; sharing credentials is not permitted. You are responsible for keeping your password confidential and for all activity that takes place under your account.
If you suspect unauthorised access, change your password immediately and notify your operator administrator and PSV CT at info@psv-ct.co.uk.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in breach of any applicable regulation (including UK GDPR, the Equality Act 2010, the PSV Conduct Regulations, KCSIE, or any contract you hold with a public authority).
- Attempt to access another tenant’s data, bypass tenant isolation, probe for security vulnerabilities, or interfere with the integrity of the Service.
- Submit content that is unlawful, defamatory, harassing, abusive, infringing, or that would breach a duty of confidence (including pupil safeguarding, medical or special-category data shared without lawful basis).
- Reverse-engineer, decompile, scrape or copy any part of the Service except as expressly permitted by law.
- Use automated tools to load-test, scrape or otherwise place an unreasonable burden on the Service.
- Resell, sublicence or make the Service available to third parties without our written agreement.
We reserve the right to suspend or terminate access where acceptable use is breached, especially where continued use would expose pupils, staff, operators or PSV CT to safeguarding, regulatory or legal harm.
5. Intellectual property
The Service, including its software, design, written training content, module catalogue and underlying platform, is owned by PSV Compliance & Training Ltd or its licensors and is protected by UK and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose during the term of your operator’s subscription. No other rights are granted.
You retain ownership of records you submit through the Service (assessment responses, walkaround checks, defect reports, etc.). By submitting them you grant PSV CT a licence to host, process and present them as part of operating the Service for the operator that employs you.
6. Operator content and data protection
For records submitted through the portal, the operator is the data controller and PSV CT is the data processor. Our processing is described in the Privacy Policy and in the data processing terms agreed with each operator. See the Privacy Policy for full detail on what we collect, why, and how long we keep it.
7. Availability, support and changes
We aim to keep the Service available 24/7 but do not guarantee uninterrupted operation. Planned maintenance, infrastructure incidents at our hosting provider, or events outside our reasonable control may cause downtime. Operator-specific service levels and support response times are governed by the contract with each operator.
We may add, change or remove features at any time. Material changes that affect operator workflows will be communicated in advance.
8. Fees
Fees and billing terms are set out in the operator’s contract with PSV CT. The pricing tiers shown on operatorassured.co.uk are indicative starting points; final pricing depends on fleet size, sector and module selection. Prices exclude VAT.
9. Limitation of liability
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under English law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
Subject to that:
- We do not exclude or limit liability for breach of UK GDPR where it cannot lawfully be excluded.
- We are not liable for indirect, special or consequential losses, loss of profit, loss of business, loss of goodwill or pure economic loss.
- Our total aggregate liability arising from or in connection with the Service in any 12-month period is limited to the fees actually paid to PSV CT by the operator in respect of the affected tenant in that 12-month period.
The limit above applies to liability in contract, tort (including negligence), breach of statutory duty, or otherwise.
10. Indemnity
You agree to indemnify PSV CT against any third-party claim arising from your breach of section 4 (Acceptable Use), including reasonable legal costs.
11. Termination
Either party may terminate access in accordance with the operator agreement. We may suspend access immediately where acceptable use is breached, where required by law, or where doing so protects pupils or other users from harm. On termination, you must stop using the Service. Records held under the operator contract will be exported and/or deleted in accordance with the agreed transition plan.
12. Changes to these terms
We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent change. Material changes will be highlighted on the homepage for at least 30 days following publication. Continued use of the Service after a change constitutes acceptance of the revised Terms.
13. Governing law and jurisdiction
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.
